Terms and Conditions
The credits, purchased or reserved cannot be transferred, sold or otherwise used for the benefit of any other development other than that specified above.
The money paid for these credits is not refundable unless the planning application is withdrawn or refused, a 10% ‘restocking fee’ of the amount already paid will be charged.
The Applicant must purchase the Permanent Credits by the earlier of:
a) 12 months from the date of this certificate; or
b) commencement of development; or
c) such earlier date as is required to discharge any planning condition relating to nutrient mitigation.
An invoice will be issued at the end of month 11 for payment if you have not completed the purchase before that time. On final payment a Credit Sales Certificate will be issued confirming the purchase of the permanent credits.
If the Applicant fails to pay the remaining Permanent Credit Price by the required date, SMP may cancel the reservation of the Permanent Credits and make those credits available for other developments. SMP may retain the administration fee, the 10% deposit and any other sums reasonably incurred or committed in reserving the credits, subject to the Terms and Conditions. Where credits are cancelled, withdrawn or no longer available for the Development, SMP may notify the relevant local planning authority that the relevant credits should no longer be relied upon for the Development.
In the event that the Planning Permission for the development specified above lapses without being commenced, the Council at its absolute discretion may resell or reissue these credits.
This certificate does not transfer any interest in land or any freestanding proprietary right. It confirms the allocation and/or reservation of nutrient mitigation credits for the Development identified above, subject to the Terms and Conditions.
This certificate does not guarantee that planning permission will be granted, that any planning condition will be discharged, or that the relevant competent authority will accept the credits as sufficient mitigation. Those decisions remain matters for the relevant local planning authority or competent authority.
The temporary credits expire on 1 April 2030.
